Criminal Profiling Topic of the Day: To Dig or Not to Dig

South African businessman Stephen Birch says he has proof of some sort of cavity beneath a second pebble driveway (put in after Madeleine McCann's disappearance) and he believes that Maddie may be buried in that particular spot, a possible grave he located with a geo-radar machine he ran over Robert Murat's property (where his mother is living) a number of times quite illegally. He admits he had no permission to be on the grounds and, under the cover of night, slipped onto the property and ran his tests. He recognizes he may be sued for this and has his lawyers in place to deal with the possibility.

I am not going to speak of legalities and ethics in this particular post. Personally, I do not approve of trespassing on private property, possibly terrifying anyone at home (although some will claim I am the pot calling the kettle black because I touched the shutters on Apartment 5A when it was vacant which were accessible from the public walkway in the resort at which I was staying). Anyway, the issue at hand I am wishing to discuss is not whether Mr. Birch should be dealt with legally, but whether there is any merit to his claim and if anyone should dig at the spot on the driveway and who that should be.

 First, to the issue of Mr. Birch's theory that Madeleine was dead on May 3rd and buried on Murat's property the same night. I will not get into his entire theory as to who was involved and why. Suffice it to say, his theory is possible, if not all that probable, at least from this profiler's experience. IF his theory were to be true, it would be a major anomaly. If Maddie is buried on Murat's property, I would have to believe that Robert Murat was himself involved in the crime, that he was a child sex predator who saw a lucky opportunity, grabbed the child, and ran back to his house with her. Then, finished with his enjoyment of the child, he would have done what most child sex predators do; kill the child straight away. Then, he would have buried her on his own property believing that he would not become a suspect and, thereby, her body would not be found with his DNA on it somewhere on the side of the road.

Do I believe that this is what happened? Do I believe Murat is involved? No, but only because the evidence, in my opinion, doesn't point in his direction (see all my blogs on the case and my Profile of the Disappearance of Madeleine McCann). I don't believe Maddie was abducted, I do believe the McCanns are involved, and my Number One choice of where Maddie would be found buried is Monte do Jose Mestre, a desolate area west of Praia da Luz where Gerry McCann's cell phone pinged.

If Murat were not involved in the disappearance of Maddie McCann and the Gerry and Kate McCanns did have something to do with their daughter's demise, I would find it highly improbable that Maddie would be buried by one of her parents (with or without the help of any of their friends) nearby on someone's private property. I find it would be extraordinary, that  under great duress right after finding her dead that evening,  Gerry would have the audacity and balls to go onto someone's property, dig a hole, and bury Maddie there in an attempt to to frame someone in the community. I could believe someone burying their child on some stranger's farm in the country in some remote and area easily accessible to the road, but just down the street on a property behind an inhabited house in the middle of town, this is too unbelievable to me. If the McCanns were involved and Gerry was seen trotting toward the beach with Maddie by the Smith family, that behavior is more in line with known behaviors of parents involved in the death of their child; he would have been in a panic and quickly trying to get her body away from the vacation residence and to a remote place where any predator could have dumped her. What might have happened after that would all depend on luck and circumstances and having more time to think things through. But to place her just down the street on someone's property, I doubt it. Could be true, but it would be extremely odd.

Now, on to the issue of should the property be dug up at that spot just to make sure? I don't object to it. Who the suspect would be if it turned out Maddie was buried on the property is secondary to locating the chid and seeing justice done for her. Also, if the theory she is buried there does not pan out, perhaps Mr. Birch and others will take that machine and a search party over to Monte do Jose Mestre and see if they can find Maddie over there.

But who decides if the driveway at Murat's should be excavated? If the police do not have probably cause and they don't believe Birch's video of his radar scanning means much, they are not going to be knocking on Murat's mom's door. Is there really any evidence pointing to the Murat property or Murat? Is that video really indicative of a grave? If it is, could it be the grave of a dog? Could that cavity be the result of some other disturbance to that ground could cause a scan that looks to Birch like a grave?

Next, should Robert Murat just say, "What the hell! Let me just shut this guy up!" and allow the driveway to be dug up?  I would say if he wasn't worried about a body being there, he could do that. But, on the other hand, even if he had nothing to do with Maddie's disappearance, he might now be paranoid someone has put her body there and he will indeed be framed, or that someone has planted some kind of evidence to make it look like a body might have been there. If I were in his shoes, I don't know what I would do.

Should the McCanns push the police or Murat to take action? Well, if I were them and I were innocent, I would damn sure want that ground dug up because it would drive me crazy not to know if Maddie was really there or not.

What do I think will likely happen? Nothing. I think the police don't have probable cause, Murat won't want to take the chance, and the McCanns, in my opinion, already know whether she is under that driveway or not. So, nothing will happen unless the Murat family no longer owns the property and the new owners have no problem with the matter being settled with a little digging on the drive. I don't think we are going to see that coming down the pike any time soon.

What I wouldn't be surprised to see is Stephen Birch ending up on the end of a Carter-Ruck lawsuit via the McCanns for claiming Maddie is dead.  We all know how the McCanns deal with differing opinions, don't we?

Events: Launch of New MissingKids Website at No. 10 Downing Street

On May 23rd, the Home Secretary Theresa May hosted a reception at No. 10 Downing Street to mark International Missing Children's Day.  The reception honored families of the missing and the work that PACT, Missing People, and CEOP have done to improve the protection of children.
The reception also marked the launch of two very important new initiatives: (1) a redesigned MissingKids website that distributes images of, and information on, missing children to police and public across the world, and (1) a pan-European free phone number (116 000) for people to call if they have information about a missing child or are missing themselves.

#McCann: #MissingPeople #PACT - Birds Of A Feather Flock Together.

A charity, a lady, a scandal

I bring to your attention the charity PACT:  Parents & Abducted Children Together.  The website of the charity informs us that PACTworks with the government, the police and other NGOs to improve the way in which missing childrenís [sic] cases are handled, so that they can be rapidly located and retrieved unharmed.” Abducted children: a fine charitable cause.  Tesco is associated with the charity. Among others, the trustees of the charity include the author Barbara Taylor Bradford, a former head of Special Branch in Northern Ireland and Sir Christopher Meyer, former British Ambassador to the United States. This is not all because the patrons include both Cherie Blair, wife of a former British Prime Minister and Laura Bush, wife of the former American president.   A very credible selection of people.

Those that donate money to charity, however wealthy they are, have limited funds to donate. A donation to one charity means a smaller or no donation to another. If asked by a friend or acquaintance for a donation to PACT, a charity founded in 1999 by Lady Meyer, the wife of Sir Christopher Meyer, one might have done so in the belief that their donation was doing good.  But was this really the case?

As the accounts of the charity show, in 2010 income was £97,805 and expenditure, £80,491. In 2009, the income was £28,445 and expenses £87,640 leading to a loss, even after taking into account unrealised investment gains, of over £50,000. When we look at expenses we can see that over £49,586  of expenses in 2010 related to the salaries of Catherine Meyer (Lady Meyer) and her administrative assistant.  The Daily Telegraph understands that nearly 70 percent of that money was related to the salary of Lady Meyer. In 2009, expenses directly related to the salaries of Lady Meyer and her assistant was £63,877. It is quite easy to see why the charity lost over £50,000 that year. Donations to the charity seem to have done more to pay the Chanel-clad Lady Meyer her salary and expenses than they have done to assist abducted children.

People set up or involve themselves in charities for all sorts of reasons and not all of the reasons are necessarily altruistic. Improving social standing, developing contacts or trying to secure a knighthood might be included as to a reason for involvement. Donors to charities understand that this is case but do not begrudge such side benefits if the charity is hugely benefitting from their efforts. Donors to charities also understand that a charity might need to employ professional staff who need to be paid. What they do not expect is that the big-wigs at the top of the charity, the so-called great and good, are paid.

It makes a mockery of giving to charity if the charitable donations are going to a person who can use the funds to purchase more Chanel suits, designer clothes that the donors cannot afford for themselves. When a beggar on a street informs us he is “homeless and hungry” and requests a donation, he might not be telling the full truth about his condition, but at least he is being honest as to who is to be the recipient of the donation .

Criminal Profiling Topic of the Day: Kate McCann appointed Ambassador for Missing People Organization - Unfuckingbelievable!

I know, I know. I should be more professional than to use such bad language, but having Kate McCann be the poster woman for people who have lost children, just blows my mind. Yes, Kate surely is pretty good at making children go missing, but it is this fact alone that should disqualify her for any ambassador position connected to missing anybodies. In fact, it should make her poison to any organization seeking money and support for finding missing persons. Not only has Kate managed to lose her child due to her own poor skills at mothering, but she has squandered millions of donor dollars on crooked and incompetent private investigators who haven't unearthed a damned clue, much less the body of her own very likely very dead daughter.

What in god's name was this Missing People organization thinking? Even if they find Kate McCann a sympathetic figure, even if they believe her daughter was really abducted, even if they believe she has truly spent five years searching for her missing child, the people who run this organization have to know that a good many people think Kate McCann is guilty of child neglect, guilty of manslaughter, guilty of covering up a crime, guilty of obstructing a police investigation, and guilty of defrauding the public of money. Who chooses such a person to represent their organization? Wasn't there one person in the leadership who said, "You know, bringing Kate McCann on board might not be such a bright idea."

Of course, Kate McCann, had she any sense of decency and concern for the purpose of such an organization should have said, "I do appreciate your kind offer and your generous support of my innocence and forgiveness of my parenting "mistake, but I wouldn't want to do harm to your organization, do more damage than good, considering how many people think I am guilty of a number of crimes. They will undoubtedly attack your organization if my name were to be linked with it."

Oh, I get why Kate didn't turn down the offer; it fits with her personality.  I am not a bit surprised. If she had turned it down, I might have actually stopped to rethink my analysis of her. Guess I don't have to do that.

So, go figure. Another bizarre occurrence in the McCann saga which involves people who shouldn't be involved with them. I never was much for conspiracy theories, but with all the high level people sticking up for the McCanns and ignoring their very concerning behaviors and misdeeds, I just have to wonder why the McCanns seem to walk on British waters, don't you?

Chelsea Hoffman : There is more than enough evidence that Madeleine McCann never left apartment 5A alive five years ago

Kate and Gerry McCann are putting themselves in the media eye again, but no amount of money pandering and publicity for book sales is going to change the facts in this case. The facts are that there is more than enough evidence that Madeleine McCann never left apartment 5A alive five years ago.

First of all, like many cases in The States that raise concern, cadaver and blood dogs 'hit' on the scent of a dead body in the McCanns' car and apartment in Portugal. No other similar evidence has been found anywhere. As you can see in the videos here, Kate and Gerry McCann have always downright refused to acknowledge or discuss the credible forensic evidence in this case.

There are other issues in the disappearance of little Maddy that bring to question the credibility of whether or not she's alive, although the forensic evidence is more than enough most of the time. There are several questions that Kate McCann was asked by investigators in Portugal back when she was named a suspect in her daughter's disappearance. Kate McCann flat-out refused to answer 48 questions that investigators asked, even after acknowledging that she knew that it would hinder their investigation. Here are some of those questions:

Is it true or not that in England you went so far as thinking about handing over Madeleine to a relative to look after?
At home (in England) did you give medication to your children and what kind of medication?

Did you have any responsibility or involvement in the disappearance of your daughter Madeleine?

The fact that the McCanns have refused to answer specific questions even during the preliminary investigation is just worrisome to say the least.

The idea that they are continuing this charade of the young girl being alive is heartbreaking. Either they are completely fooled and desperately clinging to hope, or they're both a couple narcissists on the same level as Casey Anthony. That's just a speculation.

#McCann : EXCLUSIVE - 195 Leads revealed!!! – by Unterdenteppichgekehrt

The LEADS Scotland Yard refuse to investigate. They insist abduction ONLY without a shred of evidence ! Why?

An independent investigation team consisting of an undisclosed number of case file analysts and interpreters, working for a pat on the back, have compiled what must surely be resembling much of the as yet undisclosed list of 195 leads painstakingly produced from a mass of evidence by the Scotland Yard investigation team.

After a careful review of all the evidence from the
Portuguese police files and of course omitting spurious sightings, reports from mediums and clairvoyants, we finally came to the same conclusion as the highly paid SY team in that there is a 110% probability that Madeleine is either dead or alive, each possibility ranging around the 50% marker. We can also confirm that the theory of the parents' involvement is as much a conspiracy theory as the following list. We are convinced that the person who took Madeleine from the apartment, as seen by an Irish family of 7, is a criminal and should be treated as such. ASAP!

We therefore demand that the Portuguese plods pick up the investigation again where they dropped it in 2008 and start to investigate each of the 195 leads as regards to their possible significance. Or else campaigns will be started to urge people to refrain from ever listening to Fado again.

29 Gerry claims Kate entered 5A through front door with key, Kate says patio door
30 Gerry changes his statement from Matt having seen closed shutters to Matt being unsure about the state of the shutters

31 A family of 7 encounter a man carrying a child while going home from a pub at 22:00 on May 3rd.
32 The child is of Madeleine's age and height and resembles Madeleine
33 The man is of the same height, has the same hair and general appearance of Gerry McCann
34 Mr Smith is 60-80 % certain that the person they saw was Gerry McCann
35 Aoife Smith describes the pants of the man as having buttons as ornaments
36 Gerry McCann is photographed once as owning such pants
37 The time of the encounter is the exact same time as the alleged detection of the disappearance although latter is not corroborated by independent witnesses
38 The sighting - although reported once in an irish paper - is never picked up by british media or the McCanns although it would have been the best confirmation for an abduction.
39 Only two years later the Smith sighting becomes part of their "documentary" although the key points get changed to fit the Tanner sighting
40 Pressure put on the PJ to highlight the Tanner sighting came at exactly the same time as the Smith family were being brought back to Portugal to go over the sighting in more detail
41 The sighting was in a different part of town from the Tanner sighting
42 The carrying style was completely different to that of the Tanner sighting
43 The man was heading in a completely different direction from the Tanner sighting
44 There was a time difference of 45 minutes between both sightings
45 Goncalo Amaral was removed from the case just when he tried to get the Smiths to Portugal again
46 Brian Kennedy contacted the Smiths to get them to take part in creating a photofit.
47 No innocent person ever came forward regarding the sighting
48 The child was carried without a blanket despite the cold night

49 Regarding the sighting by Jane Tanner of the abductor none of the scent tracking dogs followed the trail indicated by Jane, but different routes
50 Jeremy Wilkins (independent witness) failed to spot the abductor, despite being only yards away, while chatting to Gerry
51 Jeremy Wilkins (independent witness) failed to see Jane Tanner walking by, despite being on the same narrow sidewalk at the same time
52 Gerry McCann failed to spot the abductor, despite being only yards away, while chatting to Jeremy
53 Gerry contradicted Jeremy by stating that their chat was on the opposite side of and about 30 yards down the road from that as described, and drawn on a map, by Mr Wilkins
54 Gerry also contradicted Tanner, by stating that his chat with Jeremy was on the opposite side of and about 30 yards down the road from that mentioned by Jane
55 Jane failed to spot the open window and shutters at Madeleine's bedroom while walking to her apartment at ~21.15
56 Jane failed to spot the open window and shutters at Madeleine's bedroom while walking from her apartment at ~21.20
57 Jane never bumped into Jeremy Wilkins (who had walked back to his apartment after the chat with Gerry) while walking back from her apartment at ~21.20
58 Russell O'Brien failed to spot the open window and shutters at Madeleine's bedroom while walking to his apartment at ~21.30
59 Matthew Oldfield failed to spot the open window and shutters at Madeleine's bedroom while walking to his apartment, which was right next door, at ~21.30
60 Matthew failed to spot the open window and shutters at Madeleine's bedroom while walking back from his apartment back to check on the McCann children
61 Matthew failed to spot the open window and shutters while checking on Madeleine and the twins
62 Jane failed to spot the open window and shutters at Madeleine's bedroom while walking to her apartment at ~21.45
63 Russell failed to spot the open window and shutters at Madeleine's bedroom while walking back from his apartment at ~21.50
64 Tanner's description of the abductor has changed several times
65 Tanner's description of the pyjama's worn by the child has improved with time
66 Gerry did not hear the raising of the shutters by the abductor while standing in the street with Wilkins
67 Jeremy Wilkins did not hear the raising of the shutters by the abductor while standing in the street with Gerry
68 The abductor failed to hear either Tanner, Gerry or Wilkins, and continued on the path that would put him in the full vision of all three
69 If the abductor had lifted Madeleine out of the bed, then he would be carrying her with her head to his right hand side, not on the left as in Tanner's claimed sighting
70 Although Gerry checked all rooms in the apartment during his check he did not spot the hiding abductor
71 The abductor did not raise the shutters while Gerry was inside the apartment
72 Jane was not only not seen by Gerry and Jeremy but also not heard although she was wearing flip-flops
73 Nobody ever mentioned the cars in the road but independent witnesses spoke of at least 2 cars parked close to the pavement where Gerry and Jez were standing, narrowing Jane's path so much that it was impossible she was not noticed by the two men.
74 Jane does not inform the parents of her sighting immediately. Only some of the friends
75 Although the friends know of her sighting their searches are directed in the opposite direction of where the abductor headed to.

76 A George Brooks saw a couple at 5:55 on the morning of May 4th on his way between Lagos and Praia da Luz
77 The man was carrying a child
78 At this time the McCanns had left the apartment and were somewhere in the vicinity of Praia da Luz
79 They had left the apartment around 5:00 when the police and all search groups had left the area
80 They were never asked where exactly they had gone
81 Kate claimed in her book they "resumed" their search that early morning although they never went searching the night before
82 The night before Gerry was overheard on his mobile talking about a gang of paedophiles having abducted Madeleine

84 In their statements the friends of the McCanns have difficulty to pinpoint the last time they saw Madeleine
85 Dianne Webster, whose statements are the only consistent ones, states she saw Madeleine on the 2nd May for the last time.
86 Kate McCann claims in her book that the 2nd May was the last happy day as a family of four. What about the 3rd?
87 The creche sheets are a mess, partly filled out by the nannies in retrospect, partly not at all. No credible evidence for the whereabouts of Madeleine
88 There are no reports about the creche activity in Madeleine's group for the afternoon of May 3rd
89 There are strong discrepancies regarding the morning activity of sailing undertaken by the creche
90 The nanny does not remember if she accompanied 5 (without Madeleine) or 6 (with Madeleine) children to the beach that morning
91 Whereas her first recollections are vague they improve one year later when she recollects an incident on one of the boats where Madeleine was crying.
92 The nanny could only have entered a boat with Madeleine by leaving 3 remaining children alone on the beach
93 Initially some of the friends claimed that Madeleine had taken part in the children's tennis on the morning of the 3rd
94 Madeleine and Ella were allegedly sailing while their parents and friends watched unknown children playing tennis on the court
95 Kate went back to the apartment on Tuesday to fetch her camera for the tennis court photo of Madeleine but never bothered to even watch her sailing
96 Even in 2008 Rachael Oldfield still claimed that Madeleine had been at the tennis on the morning of the 3rd
97 While Jane claims to have seen Madeleine at the sailing, Kate now states in her book that Fiona was unsure wether Madeleine had been at the sailing

98 Changes in the holiday routine mark May 3rd as a special day
99 While the McCanns claimed they had only ever attended breakfast once on the Sunday, six employees of the Millenium restaurant stated that they had attended regularly. Did they skip breakfast only on the 3rd?
100 Lunch was usually taken in the Payne's apartment with the whole group, but not on May 3rd
101 The whole group apart from the McCanns went to the beach that afternoon - and did not see Madeleine
102 The whole group apart from the McCanns did not attend the usual children's dinner on May 3rd - and did not see Madeleine there
103 The McCanns did not take part in the get together on the children's playground on May 3rd - so Madeleine was not seen by the rest of the group
104 Russell O'Brien collected his daughter from the creche before the children's dinner - but failed to notice if Madeleine was there or not

#McCann :Profiler Pat Brown - Hurray! The Madeleine McCann Case is Near to being Solved!

"[We are] seeking to bring closure to the case," Detective Chief Inspector Andy Redwood told the BBC. "I am satisfied that the systems and processes that we are bringing to this set of circumstances will give us the best opportunity to find those investigative opportunities that we can then present to our colleagues in Portugal."

And, clearly, those 195 new leads culled from a years worth of work by the Met's 37-man team should indeed inspire the Portuguese police to reopen the case and get to work following up these valuable clues (provided to me by an unnamed source) which surely will result in the recovery of a living Madeleine McCann who can then be united with her long-suffering parents whose own five-year-long investigation using private detectives and reportedly spending millions in donated money has been a miserable failure.

But, now it is hoped that 195 new clues unearthed by the stellar British law enforcement agency previously overlooked by the bumbling Portuguese police will now be further investigated by this incompetent bunch of tossers.

#McCann: Pat Brown Picks Up On Kate McCann's Absurd Explanation For Sedating The Children.

Kate McCann has a new book out, Madeleine, an incredible self-serving propaganda piece which leads me to believe she must have read my letter (below from October 4, 2007). But, as can happen to people who may have a narcissistic personality disorder, they just don't know when to SHUT UP. For, in the book, Kate's explanations further lead me to doubt the McCanns' claims of innocence in the disappearance of their daughter. One simple example is the most peculiar speculation of Kate that all her children may have been drugged by Madeleine's 'abductor' both the night she went missing and the previous night. First of all, Kate, this would serve no purpose to the 'abductor' except to waste time and it would be difficult to accomplish. You must know that. So the only rational reason you are claiming the children might have been drugged would be to explain away the fact that, indeed, if it ever is proven they were, you have covered that issue by explaining you were concerned about the children's lethargy and someone else is responsible. However, the only ones likely to have given the children drugs would be you and Gerry.

Any good lawyer will tell you to SHUT UP, but, no, you keep talking, Kate, and we thank you for it.


Yes, Kate,

It isn’t your breast size or weight that is causing your problems. It is you and your narcissist evaluation of the situation and your PR team’s equally stupid assessment of the situation that is making you look so bad in the public eye.

I am a criminal profiler with years of experience dealing with parents of murder victims and missing relatives. Your behavior and the behavior of your husband fall far outside or the norm for grieving parents. Now, this may be because you are just terribly narcisstic folks who had nothing to do with your child going missing (outside of neglecting your children and putting your needs to party before their needs for comfort and safety, a narcissistic behavior if I have ever seen one). You and Gerry may simply be so narcissistic you have no understanding of how other people view your behaviors and your PR team may share your narcissism so that no one on your team has a clue to normal human behavior.

But, SHUT UP! Every time you open your mouths you do more damage to yourselves. You seem guiltier by the day. Your attempt at “damage control” is so obvious and so very much a day late and a dollar short, everything you do or say seems a cover up and a transparent attempt at proving your innocence.

Let me make clear what I think is weird about what you say and do:

You choose words about Madeleine’s disappearance which make it appear you know there is no abductor and that Madeleine is dead.

Both you and Gerry state your only guilt in the matter is not being their when Madeleine “was taken.” This statement makes no sense for abduction as Madeleine could not be taken if either of you were with Maddie when an abductor would have shown up. It makes more sense in the context that Maddie died while you were not in the apartment.

Your statements and attitude about Madeleine being alive do not square with parents who really believe their daughter is in the hands of a pedophile or pedophiles who are brutally raping and torturing her daily.

Your attempts at “finding” Madeleine do not represent the manner most parents would choose if they were actively searching for a live child but appear more to be the actions of parents trying to prove after the fact of a child’s death that they “cared” (not care) about her.

Your behaviors of “keeping a normal routine” and “keeping up one’s appearance” is admirable, but extremely bizarre. I don’t know any other parents of missing children who can appear so together and cheery. When my daughter cooked our kittens by accident in the dryer, I cancelled Christmas.

Gerry’s blog creeps people out. It is too upbeat. Terrified and distraught parents of missing children are rarely able to jog and play tennis and go to park with their other kids and have a fun time. Over a long period of time, maybe, but this is usually years after the nightmare begins. Some parents never recover from the trauma and it is common for marriages to fail and the brothers and sisters to feel their parents went absent after their sibling went missing.

Your ability to sleep at night after the first five days, Kate, is beyond belief. It is the behavior of one who already knows the answer and even then, is quite a narcissistic trait. If you believed your daughter was being raped as you lay in bed at night, sleep would be very hard to come by. I guess you finally realize this and your mother is saying that NOW you can’t sleep and Madeleine comes to visit you in the night. What changed, Kate?

Your PR team coming up with an answer to every accusation, answers that are ludicrous in themselves, makes you seem awfully defensive, and, if there is no way you or Gerry had anything to do with Maddie’s disappearance, you have nothing to defend. Furthermore, if all you care about is finding Maddie, you shouldn’t be wasting your time on such silliness. After all, as Gerry said, Maddie is the only important thing, right?

So, SHUT UP, Kate. SHUT UP, GERRY. Fire your PR team as they are totally worthless. If both of you really are innocent and your think Maddie is alive, return to Portugal. Start searching for real (and it took six months to set up a hotline?). Cooperate with the police. Take the polygraphs as you have zero to hide and, with competent polygraph examiners, the questions are so simple you can’t screw them up. I will even give you the four questions that should be asked:

“Did Madeleine die while you were present?”
“Did you return to the apartment and find Madeleine dying or dead?”
“Did you move Madeleine’s body at any time?”
“Did your spouse move Madeleine’s body at any time?"

These are simple questions. The answer to all of them should be “No.” There is no ambiguity in these questions (unlike a question such as “Do you feel responsible for the disappearance of Madeleine?” which you could if you acknowledge leaving her without an adult caretaker is irresponsible; an affirmative answer to such a question would be useless to the detectives as it could falsely indicate that you had something to do with Maddie going missing when you are only feeling guilty over leaving her unattended. Also, an affirmative answer could mean you simply do not feel responsible for what happened to Maddie no matter what happened to her as a total narcissist might).

The above four questions are simple and unambiguous and even a narcissist can’t misconstrue the meaning of the questions. The answers will be a simple “Yes” or “No.” Have the polygraph session videotaped so the police will be unable to do any underhanded scare tactics or interrogation that might distort the results of the tests.

Quite frankly, Kate, you and Gerry had everything going for you as parents of a missing child if you hadn’t left your children unattended night after night to go out partying. THIS is what made people dislike you. It was to your advantage that you are both relatively attractive people because IF you had big breasts and a porky physique and were not well-heeled professionals, you would have become suspects right off the bat and you would have not had the incredible monetary support you have been blessed with nor all those kindly letters. You would have been viewed as just a pair of slobs who probably abused their children as well as neglected them and you wouldn’t have gotten the phenomenal amount of publicity worldwide concerning Maddie’s disappearance. Other parents have gone public, run campaigns, and had web sites, but your fortune with publicity and support has been unprecedented. And, you complain, Kate, that people are treating you badly because you are fit! It was being fit and professional and well-off that got you so much attention. It was you and Gerry’s fitness as parents and your peculiar behaviors that got you the negative attention.

I have a final suggestion. Ask the PJ if I can come analyze the case. My organization will send me pro bono. As a criminal profiler I can analyze the actual evidence to advise the investigators as to the best investigate strategy. I have no problem determining this crime as an abduction and finding the creep that took Madeleine if the evidence points that way. I don’t have to like you and Gerry as people to view the evidence in an objective and professional manner. No one should be convicted of a crime simply because of personality and because people don’t like the individual’s personality. Solid physical and circumstantial evidence must exist to the point where there is no question as to who committed the crime. I would work very diligently to assist the PJ with the evidence and the facts and do a thorough crime scene analysis that would move the case forward.

Furthermore, if you and Gerry get charged in Madeleine’s disappearance and must truly defend yourselves, my services are available to you and your lawyers. I will be more than happy to analyze the evidence and, if you are innocent, do all I can to serve in your defense.

Good luck, Kate. May the truth be brought to light soon and you and Gerry get the justice you deserve in the case of your missing daughter.

Gonçalo Amaral - The Truth Of The Lie - AN IRISH FAMILY IN A STATE OF SHOCK.

The McCann couple return to Great Britain after more than four months spent in the Algarve. It's an almost triumphant return. The media coverage is such that you'd think you were witnessing the liberation of hostages held for years in a far-off country. Gerald McCann is shown on television carrying his son, as he descends from the plane. The child's head is against Gerald's left shoulder and his arms dangling by his sides. Gerald walks across the tarmac, still holding his son closely against himself.

In Ireland, the Smiths are watching the BBC news, which is broadcasting the event. For them, it's a shock: that person, they recognise him. That way of carrying his child, that way of walking...It's the man they saw at around 10pm on May 3rd, with a little girl, who seemed to be deeply asleep, in his arms.

This image, brings back with a jolt, that of the man they encountered in the streets of Vila da Luz, on the evening of Madeleine's disappearance. It's as if the scene is repeating itself ....Mr Smith thinking he's hallucinating, sees the same report on other channels, ITV and Sky News. From that moment, he is sure: the man they came across that night was Gerald McCann. Of that there is very little doubt. Upset by the implications of this discovery, he alerts the police and waits to be called back by those in charge of the investigation.

When we receive this information, at the end of September, we think we finally have the piece that will allow us to complete the puzzle. Because of this, we may be able to reconstruct the course of events on that cold night of May 3rd in Vila da Luz. We have a better understanding of why Jane Tanner, "sent," the alleged abductor in the opposite direction to that taken by the man seen by the Smith family. Suspicion had to be diverted from Gerald who - if he was the guilty party - would have taken this route: leaving apartment 5A, the individual who was carrying the child, did not go east, towards Murat's house, but west in the direction of the beach.

We decide to get the Smiths back to the Algarve, for a formal identification of Gerry McCann - by means of televised images, certainly - direct confrontation being impossible - and possibly proceed to a reconstruction of the events of the night of May 3rd. The National Director of the Judiciary police agrees, the process is set in motion, all the details are sorted out; all that remains is to choose the hotel where they will be put up. But the Smiths were never to come back to Portugal. After my departure, the PJ were to change their minds. They asked the Irish police to proceed with interviewing the witness. That decision was to seriously delay the process since the Smiths were not interviewed until several months later. Meanwhile, rumours were to circulate and people not involved with the investigation would be made aware of the existence of this witness; someone allegedly even sought out contact with the family, without its being known to what end.

#McCann :#Oporto police handed Madeleine review


Ten months after UK Prime Minister David Cameron announced that he had given orders to the Metropolitan Police to initiate a review into the case of missing British toddler Madeleine McCann comes news that Portuguese police are also taking another look at the evidence.

Reports in Portuguese media have revealed that a team of detectives from the Polícia Judiciária (PJ) in Oporto have been appointed to review the original investigation following Madeleine McCann’s disappearance from Praia da Luz in May 2007.
The team of detectives is under the guidance of Helena Monteiro and is believed to have started their review some weeks back.
Police sources say the case has been handed to Oporto detectives to allow for a fresh look by detectives who are close to the case.
The case was formally shelved in July 2008 by the Attorney-General who said the case would be re-opened should new evidence emerge.
Sources close to the case in Portugal have told The Portugal News that they support the Portuguese review in that they hope it will conclude “an investigation which was ended while still in its infancy.”
McCann family spokesman Clarence Mitchell told UK media: “Kate and Gerry obviously welcome the work being done by the PJ in Oporto alongside that of the Met investigative team. They clearly hope that it will lead to the case being reopened in due course.
“There is good co-operation between the Met and the PJ, and Kate and Gerry remain grateful for the time and resources that have been put into the search for Madeleine”, adding: “They will not be discussing any details whilst both the Met investigative review and the PJ work is continuing, but clearly it is a positive development.”
On 12 May 2011 the Metropolitan Police Service (MPS) announced that, at the request of the Home Secretary, it had agreed to bring its particular expertise to the Madeleine McCann case.
The then Commissioner, Sir Paul Stephenson, considered the request and took the decision that on balance it was the right thing to do. This was subject to funding being made available by the Home Office, as this case is beyond the MPS’s jurisdiction.
The MPS have reiterated on several occasions that Portuguese authorities retain the lead.
While the MPS will not provide a running commentary on its involvement, known as Operation Grange, it is felt appropriate to make the remit available to the public and it is available in the related publications.
It is estimated that Operation Grange has cost British taxpayers more than two million pounds and reportedly boasts 37 officials who are working on the review.
According to the remit, investigators are “to examine the case and seek to determine, (as if the abduction occurred in the UK) what additional, new investigative approaches we would take and which can assist the Portuguese authorities in progressing the matter.
Whilst ordinarily a review has no investigative remit whatsoever - the scale and extent of this enquiry cannot permit for such an approach.
It will take too long to progress to any ‘action stage’ if activity is given wholly and solely to a review process”, the MPS explained.
Madeleine McCann disappeared from Praia da Luz on 3 May 2007 from an apartment where she was sleeping with her younger twin brother and sister while her parents dined at a nearby restaurant.

#MCann vs Bennett : Update On The Committal To Prison Application


I post this update in the McCanns -v- Bennett committal-to-prison application for information - but will be unable to take questions on it.

Following the Case Management hearing before Mr Justice Tugendhat in the High Court on 8 February, I wrote on 13 February making proposals to Carter-Ruck for this matter to be settled without the need for what would undoubtedly be a stressful, and costly, High Court trial, now fixed for 9 and 10 May.

My proposals were not accepted.

Instead, Carter-Ruck replied on 20 February setting out the McCanns' terms for settling this matter before 9 May:

1. I admit that I have breached the undertakings given by me to the High Court on 25 November 2009

2. I formally acknowledge that these undertakings are binding on me

3. I agree to be bound by a Court injunction (instead of undertakings) in exactly the same terms as those I agreed to in 2009

4. That I 'use my best endeavours' to remove all publications, articles and postings by myself, wherever they are, to which the McCanns object, and specifically all of the 153 publications which they claimed in the original committal bundle on 1 December were breaches of one or more of my undertakings. That would include their demand that I cease to sell the book 'The Madeleine McCann Case Files: Vol 1'

5. I pay the McCanns' 'reasonable costs' of bringing the application, those costs to be assessed by the court if they cannot be agreed between me and the McCanns.

If all of that is agreed by me, they will, in return, agree not to press the court for me to be sent to prison, fined, or have my assets seized, although they point out (correctly) that despite any agreement between me and the McCanns, the court would have the right, if it saw fit, to impose any sanction that the judge saw fit to do so under the circumstances.

Carter-Ruck's letter (which by the way is not marked 'Private & Confidential' nor is it 'Without Prejudice') concludes:

I now have until Friday 23 March to submit to the Court and to Carter-Ruck a sworn Affidavit setting out in full my reasons for the application I issued at Court on 22 February to be released from Part C of my undertakings, namely that part which in effect required me not to libel the McCanns any further.

I have now completed a first draft of that.

Pat Brown ......Find The Body And Prove We Killed Her...

Before we move on to Pats latest Postarticle it is well worth remembering that we have a murder trial taking place right now in Scotland using cadaver dogs in evidence that a murder took place without forensic back-up or a body. The Suzanne Pilley Murder.

No body, no case. While this is not always so, it is quite rare to see
homicide or manslaughter charges levied against someone unless there is
exceptionally strong evidence that a person has been killed and there is
also substantial proof of how they were done in and who did it. As it
stands today, we have no such level of proof in the case of missing
Madeleine McCann; what we have is a child who hasn't shown up in five
years, no evidence of abduction, alerts from cadaver dogs, and very
concerning behavior and statements from the McCanns and their friends
and family.

Let me reiterate; I find no proof of abduction nor proof that Maddie is
alive. I believe the evidence more likely supports the theory that
Maddie died in the vacation apartment and her body was removed from
there. If the cadaver dogs are accurate in their alerts that a body was
in the apartment on May 3rd, 2007 and was moved in the hire car that the
McCanns rented weeks later, then the body was hidden locally and moved
to another location at a later date. If we follow this theory, the
following scenario is the one I believe most likely, having now spent
time in Portugal and Praia da Luz.

Following physical and behavioral evidence, I would theorize that Maddie
died in the apartment and lay behind the couch until she was
discovered. With panic ensuing, the body would most likely have been
moved by Gerry in a hurry to a location far enough away from the
apartment to not immediately have suspicion fall upon the parents. This
location would not be very secure, but because of the very limited time
frame Gerry would have had to work with, Maddie would have been simply
hidden in the weeds, or under an object or in an open isolated
structure. Then, I believe with an hour or so to work with in the early
hours of the morning, Gerry may have decided it would behoove him to
find a better hiding location and this I believe is most likely to be in
a gully on the side of the Rocha Negra, accessible from the beach and
full of loose dirt, stones, and rocks that would allow for a quick
burial (see previous blog; On Moving and Hiding Bodies).

Then, when Kate told the PJ that she had a dream about Maddie's body
being on a slab of rock and the cadaver dogs were heading to Praia da
Luz, Gerry might have decided it would be better to find a location away
from the town where she would never be found. Some think the body was
stored in a freezer at some point but I find this unlikely. If there is
some evidence in the vehicle of a body having been on ice, I would be
more likely to believe it was literally on ice in the boot. In other
words, ice was placed in the boot in a bag or bags as a method of
keeping the body cold during transport. Taking the body to an inside
location, storing it in a large freezer, and then moving it yet again
seems like an awful lot of extra moving of the body and, usually, a
person works in the direction of having the body disappear and doesn't
take the risk of bringing the body closer t him and keeping it around
for discovery. Bodies found in freezers or kept in freezers usually have
that location as the first place of rest, not an intermediary one.

There is also speculation that Gerry and Kate might have had a
contingent of helpers outside of the Tapas 7 which I also find hard to
accept. The more people one brings in on a criminal undertaking, the
more likely it is that someone will open their mouth, even accidentally.
Gerry is smart enough to know this is an unacceptable danger (any of
the Tapas 7 knowing anything is bad enough but this may have been
unavoidable and they may have more at stake to keep them quiet than
people uninvolved in the evening of May 3rd and previous days and
nights). He is also controlling enough to want to take care of things as
best he can by himself.

Before coming to Portugal, I entertained a number of possibilities: the
Huelva baths in Spain where the McCanns went just as the cadaver dogs
arriving, removal back to the UK, and incineration. Each had its
possibilities but each also seemed a bit too difficult to accomplish
(although by
no means am I saying such actions would have been impossible) and it is a
pretty good rule of thumb that people do what is easier to manage and
to pull off. Because of this, I came to two more probable conclusions,
involving Gerry driving the body to a location he felt was secluded and
unlikely to be discovered. I was particularly interested in the
activities of the McCann in the days before
the Huelva trip when Gerry's phone pinged repeatedly in an area to the west of Praia da Luz
along the road to Budens, (estre EN125). I also found it interesting that the day he was to
leave for Huelva, he was not feeling well, having a bit of an upset stomach.
This led me to theorize he could have used that day to move the body or to recover
from moving it the day before. I decided when I got to Praia da Luz, I would
take a trip down that road to the west and see whether there were any suitable
places to lose a body forever.

The first place I looked for was the kind of location for a “proper
burial” to occur, a place with some kind of religious significance like an isolated spot
in view of a little chapel so that Kate and Gerry could feel they had done
right by their daughter, a place they could find again and stop by to spend
time with Maddie, to pray for her. Being that Portugal is a heavily Catholic
country, I imagined there might be dozens of small chapels along the route much
as one can find a plethora of little mandirs (temples) in India as one travels
down just about any rural road.

Interestingly, I found none to speak of. I found churches but they were
stuck right in the middle of town. I did find a couple of graveyards on
outskirts of town which had curious possibilities in that inside the
walls of
these small cemeteries, there were quite a few graves with just a mound
of dirt
over the body rather than a concrete structure; some folks obviously
lacked the money to pay for these nice
amenities and had to bury their loved ones in a very simple fashion.
When they came into more money, they could then top the grave site with a
proper tombstone. In theory, if one could access
such a location, one could bury a small body in an already dug grave,
back the displaced dirt and no one would be the wiser that the grave
an extra corpse. Not a bad concept, but these graveyards appeared to be
and monitored, so one would have to scale the walls to get in. Possible?
but not probable.

I found no really good location within the ping area for Gerry to give
Maddie a spiritual resting place. I did find an interesting spot,
however, that I thought might have stood in nicely as it had a beautiful
view which included the Rocha Negra in the distance.

And up at the top of a hill overlooking the spot,
there appeared to be a cross which would lend some special religious
significance, like God looking down upon Madeleine in her final resting
place. This location, the Forte de Almadena, is open to
the public down a short road that one can access after dark. During the
day, there appear to be times when no one is there.

There are the remains of a fort and,
nearby, odd mounds of soft dirt that actually already look like a set of
graves. Retired British police officer, PM, and I brought out the metal
detector and spade and investigated a number of them.

The metal detector found nothing. Since it was possible Maddie could have
been buried in the oft-discussed missing sports bag, I was wanting to see if
the detector would find any metal, metal that might be on that bag. If Maddie's body were buried shallowly under
the ground in a sports bag, metal rings attaching a strap or metal zippers (although zippers
these days are almost all vinyl) could set off the metal detector. Unfortunately, it remained silent.

Then PM dug trenches across the mounds; we
found nothing. Then we drove up to look at the cross we saw on the hill; it
turned out to be a windsock. So much for the religious significance, although,
if we thought it was a cross, so could Gerry.

Does that mean Maddie couldn’t be buried at the Fort? No, it is still
possible. There is a bit of land around it that we did not have the time to
totally explore. But, then, I found a better place.

Gerry seemed to be on that road west over a period of three days which
to date has not been explained. Was he looking and looking for a spot to
bury a body? Driving off
the main road to see if there was a good place to move Maddie to? PM and
I found
an excellent place within hours of leaving Praia da Luz, so I see no
reason why
Gerry couldn’t have found it as well. However, there is no religious
significance to this location; it would simply be a great place to hide a
and never have it discovered.

Would he choose this? Part of me fought against
it, thinking these parents, especially Kate, would find comfort and some validation
as good parents and Christians if they buried Maddie in a religious place of
some kind. However, Gerry seems to be quite practical and rather cold and
calculating and he simply may have decided, Kate’s feelings be damned, that
making sure the body was never found was of paramount importance and they would
have to live with it.

Monte do Jose Mestre. This huge, desolate area covers many square metres and is filled
with a considerable network of dirt roads. Looking down on the area from atop the highest hill is a row of windmills.
Small trees and bushes are scattered throughout and the dirt is not impossible
to dig in. Gerry had just returned from England and I wouldn’t be surprised, if
he is involved in disposing of Maddie’s body, that he brought a small shovel
back with him, one that could be tossed into the bushes when he finished
digging the grave or thrown away in a dumpster on the way back to Praia da Luz.
If the body is buried out there, it would be unlikely to ever be found unless a
large contingent of searchers and dogs descended upon the area and then it would
still be pretty lucky if they located a grave. I hope, however, this is done
sometime in the future. I would like to know if Maddie is there or not.
